STANRENTAL LLC

SHORT-TERM RENTAL TERMS, CONDITIONS AND HOUSE RULES

Effective Date: 10/19/2019

These Terms, Conditions and House Rules (“Agreement”) apply to reservations made directly with StanRental LLC and to reservations made through third-party booking platforms, including Booking.com, Airbnb, Expedia and Vrbo.

By completing a reservation, submitting payment, checking in or occupying the property, the booking guest and all members of the guest’s party acknowledge that they have read, understood and agreed to this Agreement.

For reservations made through a third-party booking platform, the platform’s applicable terms, payment procedures, cancellation policy and dispute-resolution rules also apply. If a mandatory platform rule or applicable law conflicts with this Agreement, the mandatory platform rule or applicable law will control only to the extent of that conflict.


1. BOOKING GUEST AND RESPONSIBILITY

The individual named on the reservation must:

  • Be at least 21 years old;
  • Provide accurate identification and contact information;
  • Personally occupy the property unless otherwise approved by StanRental LLC in writing;
  • Be legally authorized to use the payment method associated with the reservation.

Third-party bookings are prohibited without prior written approval.

The booking guest is responsible for:

  • All registered and unregistered occupants;
  • Visitors and invitees;
  • Children and pets;
  • Compliance with these Terms and all community rules;
  • Damage, excessive cleaning, missing items, fines and other charges caused by anyone connected with the reservation.

2. RESERVATION CONFIRMATION AND PAYMENT

A reservation is not confirmed until all required payments, identification, deposits, guest information and booking-platform requirements have been completed.

The guest authorizes StanRental LLC and the applicable booking or payment platform to charge the payment method on file for valid amounts due under the reservation, including:

  • Reservation charges;
  • Approved reservation modifications;
  • Additional occupants;
  • Pet fees;
  • Damage;
  • Missing property;
  • Excessive cleaning;
  • Smoking remediation;
  • Late checkout;
  • Lost keys or access devices;
  • Parking or community violations;
  • Other documented charges permitted by law and the applicable platform.

3. CANCELLATION AND REFUND POLICY

The cancellation and refund policy displayed at the time the reservation is made governs the reservation.

Unless a different policy is displayed in the listing, reservation confirmation or booking platform:

  • Confirmed reservations become non-refundable after the applicable cancellation deadline;
  • Unused nights are not automatically refundable when a guest voluntarily leaves before the confirmed checkout date;
  • No refund is automatically due for late arrival, no-show, travel delays, transportation problems, personal schedule changes, illness, visa issues or dissatisfaction unrelated to a material failure of the accommodation;
  • A guest is not automatically entitled to a refund because the guest prefers another property, floor, view, layout, décor, mattress, neighborhood or feature that was not expressly guaranteed.

Nothing in this Agreement eliminates any consumer right or legal remedy that cannot lawfully be waived.

For third-party reservations, the cancellation and refund policy displayed by the booking platform at the time of booking also applies.


4. GUEST DUTY TO INSPECT AND REPORT

The guest must reasonably inspect the property shortly after check-in.

Any concern involving cleanliness, pests, air conditioning, plumbing, electricity, appliances, internet, access, safety, damage or maintenance must be reported promptly through the booking platform or StanRental LLC’s official contact method.

The guest’s report should include:

  • A clear description of the concern;
  • The time the condition was first observed;
  • Photographs or video when reasonably available;
  • A request for the particular assistance needed.

A guest should not wait until after checkout to report a condition that could reasonably have been inspected or corrected during the stay.


5. RIGHT TO INSPECT, REPAIR OR CORRECT

Except in a genuine emergency, the guest must give StanRental LLC a reasonable opportunity to:

  • Inspect the reported condition;
  • Send cleaning or maintenance personnel;
  • Send pest-control personnel;
  • Repair or replace an item;
  • Provide operating instructions;
  • Correct the condition;
  • Offer a comparable or upgraded replacement unit.

By reporting a problem, the guest authorizes StanRental LLC, property management, building personnel, cleaners, inspectors, maintenance personnel and pest-control providers to enter the property at a reasonable time for inspection or correction.

Reasonable notice will be provided when circumstances permit. Immediate entry may occur when reasonably necessary to protect a person, the property, neighboring units or building systems.

A guest who refuses reasonable access may prevent StanRental LLC from verifying or resolving the complaint.


6. RELOCATION OR COMPARABLE UNIT POLICY

If an unexpected issue affects the reserved unit, StanRental LLC may offer the guest a comparable or upgraded replacement unit when reasonably available.

Unexpected issues may include, without limitation:

  • Air-conditioning failure;
  • Plumbing problems;
  • Electrical problems;
  • Water intrusion;
  • Maintenance emergencies;
  • Pest or insect concerns;
  • Damage caused by a previous guest;
  • Access problems;
  • Safety concerns;
  • Building restrictions;
  • Conditions outside StanRental LLC’s reasonable control.

A replacement unit may be located:

  • In the same building;
  • In a nearby building;
  • In a similar surrounding area.

A replacement will be considered comparable when it provides reasonably similar essential accommodations, taking into account:

  • Number of sleeping areas;
  • Occupancy capacity;
  • Bathroom access;
  • Kitchen access;
  • General location;
  • Essential amenities.

StanRental LLC does not guarantee that a replacement unit will have the exact same:

  • Floor;
  • View;
  • Balcony;
  • Furniture;
  • Décor;
  • Room arrangement;
  • Building amenities.

A reasonable relocation or unit swap caused by an unexpected issue will not automatically be treated as a cancellation by StanRental LLC.

When a comparable or upgraded replacement unit is offered and accepted, the reservation will continue in the replacement unit.

If the guest refuses a reasonable comparable or upgraded replacement unit, the refusal may be treated as a voluntary decision not to use the accommodation offered. Unused nights may remain non-refundable, subject to applicable law and the applicable booking platform’s rules.

A guest’s refusal of a replacement unit does not automatically establish that the original unit was uninhabitable or that a full refund is due.


7. MATERIAL ACCOMMODATION ISSUES

Minor, temporary, cosmetic or promptly corrected issues do not automatically entitle a guest to a full or partial refund.

Examples may include:

  • A burned-out light bulb;
  • Minor cosmetic wear;
  • Temporary internet interruption;
  • A temporarily unavailable nonessential amenity;
  • Ordinary outdoor insects entering the property;
  • A short maintenance visit;
  • A delayed replacement item;
  • Conditions caused or aggravated by the guest;
  • Conditions the guest refused to permit StanRental LLC to inspect or correct.

Any refund, credit, discount, relocation or compensation will be evaluated based on:

  • The seriousness of the condition;
  • How long it lasted;
  • Whether it materially affected use of the property;
  • How quickly the guest reported it;
  • Whether access was provided;
  • Whether StanRental LLC was allowed a reasonable opportunity to respond;
  • Whether a comparable accommodation was offered;
  • Applicable law;
  • The applicable booking platform’s determination.

8. PEST AND INSECT REPORTS

StanRental LLC maintains cleaning and property-care procedures. Florida’s climate may occasionally result in insects entering a property despite reasonable cleaning and preventive measures.

The observation of an isolated insect does not, by itself, establish an infestation or that the property is uninhabitable.

A guest reporting a pest concern must:

  • Notify StanRental LLC promptly;
  • Provide photographs or video when reasonably available;
  • Identify the location where the pest was observed;
  • Preserve the area for inspection when possible;
  • Allow reasonable access for inspection or treatment;
  • Avoid leaving exposed food, garbage, open containers, doors or windows in a condition that could attract pests.

StanRental LLC may send a cleaner, inspector, building representative or licensed pest-control provider to inspect or treat the property.


9. THIRD-PARTY BOOKING PLATFORM RESERVATIONS

For reservations made through Booking.com, Airbnb, Expedia, Vrbo or another platform:

  • Payment and refund disputes should first be submitted through the applicable platform;
  • The guest should use the platform’s messaging and resolution process;
  • Refunds approved or processed by the platform will be handled according to the platform’s procedures;
  • The guest may not require StanRental LLC to bypass a pending or closed platform process by issuing a separate direct payment unless StanRental LLC agrees in writing or is legally required to do so;
  • Receiving a partial refund does not automatically establish entitlement to an additional refund;
  • StanRental LLC may rely on the platform’s written determination regarding the reservation;
  • A courtesy payment or platform-issued refund does not constitute an admission by StanRental LLC that the accommodation was defective, unsafe or uninhabitable.

StanRental LLC may submit all relevant records to the platform, including:

  • Messages;
  • Photographs;
  • Inspection reports;
  • Cleaning documentation;
  • Maintenance records;
  • Access records;
  • Relocation offers;
  • Invoices;
  • Guest communications.

10. DUPLICATE REFUNDS AND CHARGEBACKS

The guest may not obtain duplicate reimbursement for the same claimed loss from:

  • StanRental LLC;
  • A booking platform;
  • A payment processor;
  • A credit-card company;
  • An insurer;
  • Another third party.

Before filing a chargeback, the guest should make a good-faith effort to resolve the dispute through StanRental LLC and the applicable booking platform.

A guest may not knowingly misrepresent:

  • That the property was never provided;
  • That no remedy was offered;
  • That no replacement unit was offered;
  • That StanRental LLC failed to respond;
  • The amount already refunded by a platform or another source.

StanRental LLC may contest an inaccurate chargeback using the complete reservation record.


11. REVIEWS AND GOOD-FAITH COMMUNICATIONS

Guests may submit honest reviews describing their actual experience.

Guests may not knowingly publish:

  • False factual statements;
  • Fabricated photographs or evidence;
  • Threats;
  • Harassment;
  • Impersonations;
  • Confidential personal information;
  • Statements concerning events that did not occur.

A review, threatened review or offer to remove a review must not be improperly used to demand:

  • Money;
  • A free stay;
  • A refund;
  • A discount;
  • An upgrade;
  • Another benefit outside the applicable booking or dispute process.

StanRental LLC may submit communications involving suspected review manipulation, payment-for-removal demands, coercion or other policy violations to the applicable booking platform.

Nothing in this section prevents a guest from:

  • Providing an honest opinion;
  • Making a lawful complaint;
  • Contacting a regulator;
  • Seeking a lawful remedy;
  • Exercising any right that cannot legally be waived.

12. FALSE REVIEWS, DEFAMATION AND BUSINESS HARM

Guests may publish honest opinions and truthful accounts of their actual experience.

However, no guest may knowingly or recklessly publish false statements of fact, fabricated evidence, materially misleading allegations, impersonations or defamatory content concerning StanRental LLC, its properties, owners, employees, contractors or services.

If a guest publishes false or defamatory statements that cause reputational, financial, operational or other legally recognized harm, StanRental LLC reserves the right to:

  • Request correction, retraction or removal;
  • Report the content to the applicable booking platform, review website or service provider;
  • Preserve and submit relevant evidence;
  • Seek recovery of documented damages;
  • Pursue any legal remedy available under applicable law.

StanRental LLC may preserve and use relevant evidence, including:

  • Guest communications;
  • Photographs and videos;
  • Inspection reports;
  • Cleaning records;
  • Maintenance records;
  • Pest-control records;
  • Platform decisions;
  • Witness statements;
  • Revenue and booking records;
  • Communications linking review removal to a payment or other benefit.

Nothing in this section prohibits a guest from:

  • Making a truthful complaint;
  • Expressing an honest opinion;
  • Reporting a matter to a regulator;
  • Contacting a booking platform;
  • Seeking a lawful remedy;
  • Exercising any right protected by law.

Any legal action will remain subject to applicable law, including any required pre-suit notice, procedural requirements, defenses and court authority.


13. MAXIMUM OCCUPANCY

The maximum occupancy is the number stated in the specific property listing or reservation confirmation.

Only registered guests may occupy the property overnight.

The booking guest must disclose every occupant before check-in.

Unauthorized occupants may result in:

  • A fee of $50 per person, per night;
  • Correction of the reservation;
  • Removal of unauthorized persons;
  • Termination of the stay where legally permitted;
  • Additional building or community charges.

Occupancy may never exceed the limit established by law, the building, the community or the listing.


14. VISITORS, PARTIES AND EVENTS

Parties, unauthorized events, commercial gatherings, disruptive visitors and excessive noise are prohibited unless StanRental LLC provides written approval.

Quiet hours are from 10:00 p.m. to 7:00 a.m.

Serious or repeated violations may result in:

  • Removal of unauthorized visitors;
  • Termination of the stay where permitted;
  • Community fines;
  • Security expenses;
  • Damage charges;
  • Loss of refundable amounts where permitted.

A termination caused by a serious guest violation does not automatically entitle the guest to a refund for unused nights.


15. PET POLICY

Pets are permitted only when:

  • The specific property listing allows pets;
  • The pet is disclosed before arrival;
  • The applicable pet fee is paid;
  • StanRental LLC provides written approval.

The standard approved pet fee is $159 per stay, unless a different amount is displayed in the listing or reservation.

An undisclosed or unauthorized pet may result in:

  • An unauthorized-pet charge of up to $450;
  • Additional cleaning charges;
  • Pest-treatment costs;
  • Damage charges;
  • Community fines;
  • Termination of the stay where legally permitted.

The guest is responsible for all pet-related:

  • Damage;
  • Odors;
  • Stains;
  • Waste;
  • Noise;
  • Fleas or pest treatment;
  • Building violations.

This section does not limit rights involving a legally protected service animal. Requests involving a service animal or reasonable accommodation will be handled in accordance with applicable law.


16. SMOKING, VAPING AND ODORS

Smoking, vaping, marijuana use, incense burning and other smoke- or odor-producing activities are prohibited inside the property and in any restricted balcony or community area.

A verified violation may result in a charge of up to $1,000 per occurrence, plus actual documented costs for:

  • Deodorizing;
  • Smoke remediation;
  • Cleaning;
  • Damage;
  • Community fines;
  • Lost rental time where legally recoverable.

Evidence may include:

  • Odor;
  • Ash;
  • Residue;
  • Photographs;
  • Smoke-detector records;
  • Cleaning reports;
  • Professional remediation findings.

17. CHECK-IN AND CHECKOUT

Standard check-in begins after 4:00 p.m.

Standard checkout is no later than 10:00 a.m.

Early check-in or late checkout requires written approval and is subject to availability.

Unless another amount is quoted, an approved early check-in or late checkout may be charged at $35 per hour.

Remaining after checkout without authorization may result in:

  • $35 per hour;
  • An additional nightly rate for a substantially late departure;
  • Additional cleaning expenses;
  • Relocation costs for an incoming guest;
  • Lost-booking costs where legally recoverable.

Payment of a late fee does not give the guest a right to remain after the authorized departure time.


18. SELF CHECK-IN AND ACCESS DEVICES

The guest is responsible for:

  • Following self-check-in instructions;
  • Safeguarding keys, cards, fobs, remotes and parking permits;
  • Locking the property;
  • Preventing unauthorized access.

Possible replacement charges include:

  • Lost key or access fob: up to $300;
  • Lost television remote: $50;
  • Parking permit or access device: actual replacement and administrative cost.

The guest may not copy, transfer, lend or misuse any access credential.


19. PROPERTY CONDITION AND DAMAGE

The guest must notify StanRental LLC promptly of any existing damage discovered at check-in.

The guest is responsible for damage, loss, excessive cleaning, missing property or unauthorized alterations caused by:

  • The booking guest;
  • Other occupants;
  • Visitors;
  • Children;
  • Pets.

Evidence may include:

  • Check-in photographs;
  • Checkout photographs;
  • Inspection reports;
  • Repair estimates;
  • Replacement receipts;
  • Access records;
  • Building reports;
  • Booking-platform communications.

Normal wear and tear will not be charged as guest damage.


20. SECURITY DEPOSIT

A security deposit of $250, or the amount stated in the specific listing or reservation, may be required.

The deposit may be applied to valid charges involving:

  • Damage;
  • Missing property;
  • Excessive cleaning;
  • Smoking;
  • Unauthorized pets;
  • Unauthorized guests;
  • Lost keys or access devices;
  • Parking or community fines;
  • Late checkout;
  • Other documented charges due under this Agreement.

Any remaining refundable balance will be returned according to the applicable payment processor’s or booking platform’s procedures.


21. STARTER SUPPLIES

StanRental LLC provides a reasonable starter supply of basic household items.

For longer stays, guests may be responsible for replenishing consumable items, including:

  • Toilet paper;
  • Paper towels;
  • Trash bags;
  • Laundry detergent;
  • Dishwashing products;
  • Soap;
  • Other routine household supplies.

Additional delivery may be available for a fee.


22. AMENITIES AND SERVICE INTERRUPTIONS

Amenities may temporarily become unavailable because of:

  • Maintenance;
  • Building management;
  • Utility providers;
  • Internet providers;
  • Weather;
  • Safety issues;
  • Community restrictions;
  • Circumstances outside StanRental LLC’s reasonable control.

StanRental LLC does not guarantee uninterrupted availability of:

  • Internet;
  • Television service;
  • Pool;
  • Gym;
  • Elevator;
  • Parking;
  • Building-controlled facilities;
  • Third-party services.

A temporary interruption of a nonessential amenity does not automatically entitle the guest to a refund.


23. PERSONAL SAFETY AND USE OF THE PROPERTY

Guests must use the property and its amenities responsibly.

The booking guest is responsible for supervising children and other members of the guest’s party.

Guests must exercise reasonable care when using:

  • Stairs;
  • Elevators;
  • Balconies;
  • Parking areas;
  • Gym equipment;
  • Appliances;
  • Hot water;
  • Pools;
  • Other amenities.

To the maximum extent permitted by law, StanRental LLC is not responsible for injury or damage caused by:

  • Guest negligence;
  • Misuse;
  • Failure to follow instructions;
  • Unauthorized activity;
  • Acts of third parties;
  • Conditions outside StanRental LLC’s reasonable control.

Nothing in this Agreement releases StanRental LLC from liability that cannot lawfully be waived.


24. PERSONAL PROPERTY AND LOST ITEMS

Guests are responsible for their personal belongings.

StanRental LLC is not responsible for personal property that is lost, stolen, misplaced, abandoned or left behind, except where liability cannot legally be excluded.

When an item is found, StanRental LLC may, as a courtesy:

  • Hold it temporarily;
  • Arrange pickup;
  • Ship it at the guest’s expense;
  • Charge reasonable handling and shipping costs.

Unclaimed items may be discarded or donated after a reasonable period.


25. PARKING AND COMMUNITY RULES

Guests must comply with all:

  • Condominium rules;
  • Homeowners’ association rules;
  • Apartment-community rules;
  • Parking requirements;
  • Pool and gym rules;
  • Noise restrictions;
  • Access requirements;
  • Elevator policies.

The guest is responsible for fines, towing, immobilization, access suspension or other consequences caused by the guest’s violation.

Parking is permitted only as expressly authorized.


26. TERMINATION OF STAY

StanRental LLC may terminate a stay when reasonably necessary and legally permitted for:

  • Nonpayment;
  • Fraud;
  • False identification;
  • Unauthorized occupants;
  • Parties;
  • Serious noise violations;
  • Smoking;
  • Illegal activity;
  • Threats or harassment;
  • Property damage;
  • Unsafe conduct;
  • Unauthorized pets;
  • Material breach of these Terms;
  • Refusal to comply with building or community requirements.

Termination caused by the guest’s material violation does not automatically entitle the guest to a refund for unused nights.


27. TEMPORARY AND TRANSIENT OCCUPANCY

The reservation is for temporary and transient lodging only.

It is not intended to create:

  • A residential lease;
  • A landlord-tenant relationship;
  • A leasehold interest;
  • A permanent right of possession;
  • A right to remain beyond the confirmed checkout time.

The guest agrees to vacate the property by the confirmed checkout date and time, subject to any rights that cannot lawfully be waived.


28. FORCE MAJEURE

StanRental LLC is not responsible for delays, interruptions, relocation or inability to perform caused by circumstances beyond its reasonable control, including:

  • Hurricanes;
  • Floods;
  • Fires;
  • Government orders;
  • Building closures;
  • Utility failures;
  • Civil emergencies;
  • Natural disasters;
  • Transportation shutdowns;
  • War;
  • Terrorism;
  • Other extraordinary events.

StanRental LLC may provide a relocation, credit, date change or refund when:

  • Required by law;
  • Required by the booking platform;
  • Voluntarily approved in writing.

29. LIMITATION OF LIABILITY

To the maximum extent permitted by law, StanRental LLC’s total liability arising from a reservation will not exceed the amount actually paid to StanRental LLC for the affected reservation.

This limitation does not apply to liability that cannot legally be limited or excluded.

To the maximum extent permitted by law, StanRental LLC will not be liable for indirect, incidental, special, punitive or consequential damages, including:

  • Loss of enjoyment;
  • Lost business opportunities;
  • Emotional distress;
  • Travel expenses not expressly assumed by StanRental LLC.

30. INDEMNIFICATION

To the extent permitted by law, the booking guest agrees to indemnify and hold harmless StanRental LLC, its owners, managers, employees and agents from claims, losses, penalties, damage or expenses caused by:

  • The guest’s breach of this Agreement;
  • Conduct of occupants, visitors or pets;
  • Guest negligence or intentional misconduct;
  • Violation of law or community rules;
  • Damage caused to the property or a third party.

This provision does not apply to claims caused solely by StanRental LLC’s unlawful conduct or liability that cannot legally be waived.


31. GOVERNING LAW AND VENUE

This Agreement is governed by the laws of the State of Florida, without regard to conflict-of-law principles.

To the extent legally permitted, a court proceeding arising from a direct reservation or stay must be brought in the Florida county where:

  • The property is located;
  • The cause of action occurred;
  • StanRental LLC maintains its principal place of business.

Mandatory platform procedures, cardholder rights and legal rights that cannot be waived remain applicable.


32. ATTORNEY’S FEES, COURT COSTS AND LEGAL EXPENSES

Except where otherwise required by applicable law, a binding booking-platform rule, a written settlement agreement or a final court order, each party shall be solely responsible for its own:

  • Attorney’s fees;
  • Legal consultation fees;
  • Court costs;
  • Filing fees;
  • Expert-witness fees;
  • Travel expenses;
  • Collection expenses;
  • Mediation expenses;
  • Other legal or administrative expenses.

StanRental LLC shall not be responsible for reimbursing a guest for attorney’s fees, court costs, filing fees or other legal expenses voluntarily incurred by the guest.

No guest may add attorney’s fees, court costs, collection charges or legal expenses to a refund demand unless such amounts are expressly authorized by applicable law, a written settlement signed by StanRental LLC or a final court order.

Nothing in this section limits a court’s authority to award attorney’s fees, costs, sanctions or other relief when authorized or required by applicable law.


33. ELECTRONIC COMMUNICATIONS

The guest agrees that notices, disclosures, invoices, instructions and other communications may be delivered electronically through:

  • Email;
  • Text message;
  • Booking-platform messaging;
  • The contact information provided with the reservation.

The guest is responsible for maintaining accurate contact information and monitoring communications before and during the stay.


34. ENTIRE AGREEMENT

This Agreement, together with the following, constitutes the agreement governing the reservation:

  • The specific property listing;
  • The reservation confirmation;
  • The cancellation policy displayed at booking;
  • Written house rules;
  • Applicable booking-platform terms.

Oral statements do not modify this Agreement unless confirmed in writing by StanRental LLC.


35. SEVERABILITY

If a provision of this Agreement is found invalid or unenforceable, the remaining provisions will continue in effect.

Any invalid provision will be interpreted as narrowly as reasonably necessary to make it lawful and enforceable where possible.


36. NO WAIVER OR ADMISSION

StanRental LLC’s decision not to enforce a provision on one occasion does not waive the right to enforce it later.

A courtesy, partial refund, credit, relocation, discount, repair or exception does not constitute:

  • An admission of liability;
  • An admission that the property was uninhabitable;
  • A permanent change to StanRental LLC’s policies;
  • An agreement to provide additional compensation.

37. CHANGES TO THESE TERMS

StanRental LLC may update these Terms from time to time.

The version displayed or provided at the time the reservation is made will generally govern that reservation, unless:

  • A later change is required by law;
  • A later change is expressly accepted by the guest;
  • A mandatory platform rule requires otherwise.

38. ACCEPTANCE OF TERMS

By booking, paying, checking in or occupying the property, the booking guest confirms that the guest:

  • Has read these Terms;
  • Understands these Terms;
  • Had an opportunity to ask questions;
  • Accepts these Terms;
  • Will ensure that all occupants, visitors and pets comply with them.
